These Terms of Service ("Terms") govern your use of the TrueTest Labs website (truetestlabs.com) and our testing services. By using our website, submitting an order, or indicating your acceptance when prompted, you agree to these Terms. If you do not agree, please do not use our website or order our services.
1. Services
TrueTest Labs provides drug, alcohol, DNA, and DOT-regulated specimen collection and testing coordination services. We coordinate collections through our own facility in Elk Grove Village, Illinois, through mobile collectors dispatched to client locations, and through a nationwide network of qualified third-party collection sites.
We coordinate testing through accredited and certified laboratory partners. The certifications and accreditations that apply vary by laboratory and by test type — for example, federal (SAMHSA/HHS) certification applies to urine and, where offered, oral fluid drug testing, while hair, sweat, DNA, and other matrices are performed by laboratories under their applicable accreditations. We will identify the laboratory and its relevant accreditation for any test on request. TrueTest Labs is not a laboratory — we are a testing coordinator and third-party administrator.
2. Ordering and payment
Orders placed through our website are requests for service. We will confirm receipt and coordinate collection within one business day. Pricing for DNA testing is listed on our website. Pricing for drug, alcohol, DOT, and workplace testing varies by test type, specimen, and collection method — contact us for a quote.
For individual orders, payment is due at the time of collection or before the specimen is submitted to the laboratory for analysis. We hold specimens and do not submit them for analysis until payment is received in full. For employers and organizations with an established billing arrangement, testing is invoiced under the terms of that arrangement.
We reserve the right to decline service at our discretion.
3. Accuracy of information
You are responsible for providing accurate information on all order forms, including donor name, date of birth, contact information, and test type. Incorrect information may result in delays, invalid results, or the need for recollection at additional cost.
4. Test results and chain-of-custody
All test results are confidential and disclosed only to authorized parties as described in our Privacy Policy. Chain-of-custody procedures follow federal guidelines (49 CFR Part 40 for DOT-regulated tests) and industry best practices for non-regulated tests. Results are provided to the ordering party and, where applicable, to the donor, designated employer representative (DER), court, or attorney of record.
TrueTest Labs does not provide medical, legal, or forensic advice. Any information we provide about test types, panels, or methodology is general and educational only. Test results should be interpreted by qualified professionals (physicians, MROs, and your attorney), and the decision of what testing to obtain for any legal matter rests with the requesting party, their counsel, or the court.
5. DOT consortium enrollment
Consortium enrollment agreements submitted through our website constitute binding contracts between TrueTest Labs and the enrolling employer, as detailed in the consortium agreement presented at the time of enrollment. Electronic signatures on consortium enrollment forms are legally binding under the federal E-SIGN Act (15 U.S.C. § 7001) and the Uniform Electronic Transactions Act.
6. Remote video-observed testing
Remote video-observed oral fluid testing provides presumptive (screening-level) results only. These results are not laboratory-confirmed and are not court-defensible as standalone evidence. Any presumptive positive result triggers our standard escalation protocol: the donor is directed to provide a specimen under full chain-of-custody at a collection site or via mobile collector for laboratory confirmation.
7. No advice; no professional relationship; independent judgment
Any information TrueTest Labs provides about test types, panels, specimens, methodology, or suitability — whether through our website, our staff, our written or verbal communications, or any tool we make available — is general and educational only. It does not constitute medical, legal, or forensic advice, and it is not a recommendation that any particular test be ordered in any particular matter.
Using our website or services, or receiving any information or guidance from us, does not create any physician-patient, attorney-client, or other professional or advisory relationship between you and TrueTest Labs.
You are responsible for exercising your own independent judgment — and, where appropriate, for obtaining advice from your own attorney, physician, or other qualified professional — in deciding what testing to obtain and whether any test is suitable for your purpose. The selection of testing for any legal proceeding is determined by the requesting party, their counsel, or the court, not by TrueTest Labs, and whether a test or its results are admissible or accepted in any matter is determined by the relevant court or decision-maker, not by TrueTest Labs.
You acknowledge that you are not relying on TrueTest Labs for professional advice in making these decisions, and that any general information we provide is not a substitute for advice from your own qualified professional or for your own independent evaluation.
8. Website use
You may not use our website for any unlawful purpose or in violation of these Terms. You may not attempt to gain unauthorized access to our systems, interfere with website operation, or submit false information through our forms. Content on this website (text, design, logos) is owned by TrueTest Labs and may not be reproduced without permission.
9. Limitation of liability
TrueTest Labs' liability for any claim arising from our services is limited to the amount paid for the specific test or service at issue. We are not liable for indirect, incidental, or consequential damages, including but not limited to lost custody rights, employment decisions, or legal outcomes resulting from test results. We are not responsible for delays or errors caused by third-party laboratories, collection sites, or shipping carriers.
10. Indemnification
You agree to indemnify and hold harmless TrueTest Labs, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your provision of inaccurate information.
11. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or our services shall be brought and resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction and venue of those courts.
12. Changes to these Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
